Abraham Ovadia successfully defends a Florida chiropractor against major insurer recovery claims, reaching a resolution with no admission of wrongdoing.
BOCA RATON, FL, UNITED STATES, October 23, 2026 /EINPresswire.com/ — Abraham Ovadia represented a Florida chiropractor who was sued by a major auto insurance company in federal court (Case No.: 1:26-cv-23174-RAR). The allegations included Civil RICO claims and asked for $1.2 million dollars to be paid back to the auto insurance company in what is known as a clawback lawsuit.
The lawsuit involved claims that a licensed massage therapist performed treatment on a PIP patient contrary to the Florida Statute 627.736. The lawsuit also alleged that the chiropractor was billing higher level examination codes of 99204 and 99205 for routine examinations that did not correspond to the level of medical complexity of the patient’s injuries. Basically, 99204 and 99205 pay more than 99203. Many doctors in Florida bill the 99204 and 99205 examination codes incorrectly believing that the “amount of time” spent performing the examination is the only factor. These doctors are misled by billing companies who neglect to inform them that the “level of medical decision making” is another major factor.
Essentially, a person who was involved in a minor car accident and is merely performing a routine check-up and claiming they have “no pain or limitations and just want a check-up” would obviously be a lower evaluation code of 99203 regardless of how much time was spent with the patient.
Abraham Ovadia was able to resolve the Civil RICO lawsuit filed against the Florida chiropractor in federal court before discovery and depositions took place. The chiropractor disputed the allegations and admitted no wrongdoing as part of the settlement.
